In Davidson v. Wyeth, Inc., the trial court said that Plaintiff’s expert could not testify because of federal law based on the Daubert case. The Eighth Circuit reversed the trial court and held that the Expert could testify that the defective drug increased the risk of breast cancer. In other words, the expert will be able to testify that Prempro proximately caused Plaintiff to suffer personal injury.
