Postnuptial Agreement

A Postnuptial Agreement is a contract entered into between two parties after the marriage has taken place, which can dictate property rights in the event of a divorce. Alabama courts commonly uphold these agreements as long as the parties disclose their financial assets, are not under duress or coercion at the time of signing and have had an opportunity to obtain separate legal advice.  Postnuptial Agreements can encompass many areas of assets including family businesses, inheritance, alimony, real property, financial accounts, personal property, etc.  The attorneys at Hodges Trial Lawyers are experienced in drafting and reviewing Postnuptial Agreements as well as litigating whether or not the agreement is enforceable during a divorce.
