Alabama typically enforces three types of alimony or “maintenance” which is designed to support the spouse and/or terminate property interests– Periodic Alimony, Alimony in Gross and Rehabilitative Alimony.  The Court has wide discretion in determining whether alimony should be present in a Final Decree of Divorce, but will consider factors involving “need” and “ability to pay” which can include the length of marriage, earning capacity of spouses, standard of living during the marriage, health of the parties, sources of common property, conduct of the parties with reference to cause of divorce and many other facts.  Our family law attorneys can assess your case and give advice regarding whether you may be entitled to alimony or responsible for paying alimony.
