The law in Alabama defines an assault and battery as “any touching by one person of the person or clothes of another in rudeness, in anger, or in a hostile manner.” In order to prevail in an assault and battery case, you must be able to prove the following factors:
- You were touched by the aggressor;
- The aggressor intended to touch you; and
- The aggressor’s touching was done in an offensive or harmful manner.
