Inadequate Security
Many Americans live in community based arrangements like apartments, condominiums, town homes, nursing homes, assisted living homes, and gated neighborhoods. We often choose to live in such environments because we are looking for and wish to pay for the additional security that such places should provide.
In fact, the premises owners, developers, and management companies that own and operate such communities often market such living arrangements to us based on the additional security that they promise to provide to the parents, husbands, wives, and children who live there. Sometimes, however, these premises owners, developers and management companies charge more for such properties yet fail to provide the additional security services that they promised when they were marketing the property.
Cole and Hodges believe that such developers and management companies should be held accountable when they fraudulently or negligently fail to provide promised security services and thereby cause citizens to fall prey to the very criminal elements we were supposed to be protected from. Obviously, developers and management companies cannot be held accountable for every criminal who might rob, burglarize, attack, or sexually assault someone. But if developers or management companies do promise such services, then they owe a duty to provide those services in a non-negligent fashion consistent with the promises they made. Likewise, the security companies that are hired to provide such services owe a duty to behave in a reasonably prudent fashion.
For instance, it would be totally inappropriate for such companies to ignore a history or pattern of criminal activity in an effort to mislead you into believing that a particular apartment complex is safer than it actually is. It also would be just as inappropriate for a security guard to fail to make rounds or to sleep on the job, thereby allowing criminals or predators to roam freely on the premises.
