Kenny Cole handled a lawsuit in 1989 that helped end the practice of pizza companies who promised they would deliver your pizza within 30 minutes or it was free. Cole felt this marketing scheme had resulted in the hiring of anyone who was willing to deliver pizzas quickly, no matter what kind of safety driving record they had. He also felt pizza companies were putting undue pressure on delivery drivers to drive too fast and too recklessly so they would not lose revenues on all the "free" pizzas. As a result, Cole's client was struck by a delivery truck while she was riding her bicycle on a quiet neighborhood street.
Cole forced the nationwide pizza maker to produce a copy of the corporate safety policy on what kind of minimum safety record delivery drivers were supposed to have. The written policy also stated that driving records were supposed to be checked both before employment and periodically thereafter. The pizza maker was forced to admit it had not ordered this driver's history of traffic violations before he was first hired. Cole also obtained evidence that this driver was fired for his involvement in a hit-and-run collision, but was later re-hired once again without ordering his driving record.
Cole decided that he needed to obtain further evidence to convince a jury that the "free if not delivered in 30 minutes" marketing scheme must be ended. Therefore, he forced Defendant to admit that 21 of 53 of its delivery drivers in the county in question had so many traffic violations on their driving records that Defendant never should have hired them or should have fired them during their employment. The corporate pizza chain settled for $2 million on the Friday evening before the case was scheduled for trial the next Monday morning. This case was one of the nails in the coffin of the "free if not delivered in 30 minutes" marketing schemes of pizza companies across America.
